🏛️ 1. Owner Information (LSSI-CE)

In compliance with Article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSI-CE), the details of the owner and technical manager of this project are detailed below:

🧠 2. Nature of the Service and Use of AI

Bardie is a virtual conversational assistant powered by Large Language Models (LLM), specifically through the Google Gemini Pro™ API. The user acknowledges and accepts the probabilistic nature of Artificial Intelligence.

2.1. Hallucinations and Accuracy

Although the model has been trained and constrained (Prompt Engineering) to rely exclusively on the client's catalog, AIs can generate inaccurate or unexpected content ("hallucinations"). The owner is not responsible for commercial promises, discounts, or erroneous descriptions that the AI may generate anomalously in a production environment.

2.2. Third-Party Dependencies

The service depends directly on the uptime and latency times of Google Cloud servers. Rafael Gil Sansó is not responsible for service outages arising from problems in Google LLC's infrastructure.

🔐 3. Intellectual and Industrial Property

The entire architecture of the Bardie system is the exclusive property of Rafael Gil Sansó. This includes, but is not limited to:

• The source code, integration scripts (JSON Payloads), and interface design (UI/UX).
• Prompt engineering and the master instructions of the system.
• The logical framework of "The 7 Psychological Buyer Archetypes" and the "Three-Gate Method" qualification system.

Reverse engineering, copying, distribution, or commercialization of the sales flow or the underlying psychological architecture of Bardie without express authorization is strictly prohibited. Contracting the service grants a license of use, in no case the assignment of the core engine or intellectual property.

💶 4. Economic Conditions and APIs

The implementation of Bardie involves costs structured in two clearly differentiated areas to guarantee transparency with the client:

• Maintenance (Owner's Fee): There is a monthly fee of 150€ for catalog refinement, archetype adjustment, system updates, and technical support.
• Infrastructure Costs (Google API): To ensure privacy and scalability, Bardie runs under the client's own Google API key. Costs per token (language processing) are billed directly by Google to the client, without intermediaries or surcharges applied by the owner.

Failure to pay the maintenance fee will entitle the owner to pause or suspend the virtual assistant service upon prior notice.

🛡️ 5. Privacy and Data Processing (GDPR)

Bardie has been designed under the principle of Privacy by Design, operating as follows to comply with the General Data Protection Regulation (GDPR):

• Minimal capture: Bardie only requests the strictly necessary data (Name, Email, and booking details) in the final phase of closing the sale.
• Transmission, not storage: The captured data is immediately sent to the client's channels (Email, Webhook, Mailchimp). Bardie does not store customer databases on its own servers.
• Model Training: As per Google's commercial API policy, the data entered by end-users in the chat is not used by Google to train its public models.

⚖️ 6. Jurisdiction and Dispute Resolution

For the resolution of all controversies or questions related to this website, the Bardie service, or the activities carried out therein, Spanish legislation shall apply.

The parties expressly agree to submit to the Courts and Tribunals of Tarragona, Spain, waiving any other jurisdiction that may correspond to them.
